You and your partner need to discuss the topics that are important to you, how you want to approach them, and the restrictions or conditions you want to include. Inserting specific sections dealing with each of the most important issues is important, even if you don`t want to give anything, pass on, or share anything else. Waiver statements can be as important as other clauses. For example, if you and your partner want to live together, but want to get your individual property so you can leave it to your adult children, you can waive the right to get property from your partner as an heir. If you indicate this in writing, instead of completely omitting a single section of ownership, your intentions will be made clear to anyone who will review the agreement later. Provisions that set out in advance matters relating to custody, attendance and maintenance of the child may be ignored by a court. A concubine agreement must also be signed, certified and accompanied by a financial disclosure in Canada in order for it to be valid.
No one can legally compel you to enter into a contract. For a court to enforce the terms of your concubine agreement, you must be able to prove that you and your partner chose to enter into the agreement voluntarily, without being excessively influenced, deceived, forced or coerced to unfairly consent to the terms. The concubine agreement may need to be reassessed if the circumstances of the relationship change – for example, if you later have children, move, or notice a significant change in your financial situation. While it`s unclear whether a Virginia prosecutor would ever charge someone with incompetence, the law may make it less likely for a court to enforce an agreement that assumes a crime is committed. It is important to keep in mind that a concubine agreement cannot replace or deny other legal rights – therefore, a right introduced by marriage is not normally refuted by such a document. . . .
